The contract is deemed concluded upon the electronic submission of the order confirmation by the customer and its receipt by SANGIORGIO. Submission of the order confirmation also entails the following:

for the Customer: unconditional acceptance of, and the obligation to comply with, the conditions and terms set out in this “General Terms of Sale” section

for SANGIORGIO: the undertaking to supply the products on the conditions and terms set out in this section, except in cases where the customer does not provide adequate guarantees of solvency or does not fall within the Final Consumer category

INTELLECTUAL PROPERTY

All content of the sangiorgiomerate.it website (drawings, illustrations, photographs, texts, graphics, descriptions, trademarks, images, videos) is the exclusive property of SANGIORGIO or is licensed to it for use.

APPLICABLE LAW AND PLACE OF JURISDICTION

Contracts concluded on the sangiorgiomerate.it website and these terms are governed by Italian law, in particular by Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 on electronic commerce, to the exclusion of the conflict-of-laws rules of private international law. The mandatory consumer protection provisions of the law of the Customer's country of habitual residence remain unaffected where they are more favourable.

Where the Customer is a consumer resident or domiciled in Italy, pursuant to art. 66-bis of the Consumer Code the mandatory territorial jurisdiction lies with the court of the place of their residence or domicile.

Where the Customer is a consumer resident or domiciled in another country, they may bring proceedings, at their own option, before the court of their own place of residence or domicile or before the Court of Lecco, where SANGIORGIO srl has its registered office.

Where the Customer is not acting as a consumer, the Court of Lecco shall have exclusive jurisdiction over any dispute.

Before bringing proceedings before a court, the Customer is invited to report the problem by writing to info@sangiorgiomerate.it: most complaints are resolved at this stage.

SANGIORGIO srl gives no warranty whatsoever that the materials and content of the website comply with the legislation of countries other than Italy. Access to the content of the website from countries in which that content or its use is unlawful is strictly prohibited; Users who choose to access it from such countries are aware of the legal consequences and risks they incur and shall be solely responsible for them.
