SANGIORGIO srl operates this store and website, including the information, content, features, tools, products and services, in order to provide you, the customer, with a proper shopping experience (the "Services"). The store is built on the Shopify platform, which enables us to provide you with the Services.

The terms and conditions below, together with any policy contained therein ("Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

By visiting, interacting with or using our Services you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not accept these Terms of Service or the Privacy Policy you must not use or access our Services.

By accepting these Terms of Service you declare that you are of legal age under the law of the country in which you reside, and that you have given us your consent to allow any minors connected to you to use the Services on devices you own, have purchased or manage.

All product descriptions are subject to change at any time, without notice and at our discretion. We reserve the right to discontinue any product at any time and to limit from time to time the quantities of the products offered to any person, geographical area or jurisdiction.

SECTION 3 - ORDERS

When you place an order you are making an offer to purchase. SANGIORGIO srl reserves the right to accept or refuse your order at its discretion for any reason. Your order is not confirmed until SANGIORGIO srl confirms its acceptance. Before accepting an order we must receive and process payment. Please check your order carefully before submitting it, as SANGIORGIO srl may not be able to meet requests to cancel an order after acceptance. If an order is refused, modified or cancelled, we will notify you by contacting you at the email address, billing address and/or telephone number you provided when submitting the order.

The rights the law grants you as a consumer remain unaffected, including the right of withdrawal and the legal guarantee of conformity. The legal guarantee is provided for by articles 128 and following of Legislative Decree 206/2005 (the Italian Consumer Code), lasts two years from delivery, is free of charge and is added to any commercial guarantee the manufacturer may offer: you will find the detail of your rights and of how to claim it on the Legal guarantee page. You represent and warrant that you are making purchases for personal or household use and not for resale or export.

SECTION 4 - PRICES AND BILLING

Prices, discounts and offers are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is submitted, and you will be able to see it in the order confirmation email. Unless otherwise specified, published prices do not include taxes or customs, shipping, handling and import costs.

The prices published in our online stores may differ from the prices offered in physical or online stores or in other stores operated by third parties. From time to time we may run offers on the Services that affect prices and that are subject to terms and conditions independent of these Terms. In the event of a conflict between the terms of an offer and these Terms, the terms of the offer will prevail.

You represent and warrant that (i) the credit card details you provide are true, accurate and complete, (ii) you are authorised to use that credit card for the purchases, (iii) the charges made to you will be honoured by the credit card company, and (iv) you will pay the charges made to you at the published prices, including shipping and handling taxes and all other taxes where applicable.

SECTION 5 - SHIPPING AND DELIVERY

All delivery times indicated are estimates and are not guaranteed. We are not responsible for delays attributable to shipping couriers, customs procedures or events outside our control. We will in any case provide you with our assistance until your parcel is delivered. Shipping conditions are set out in our Shipping Policy.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including but not limited to trademarks, brands, texts, displays, images, graphics, product reviews, video and audio, as well as their design, selection and arrangement, are the property of SANGIORGIO srl, its affiliates or licensors and are protected by Italian, European and international laws on trademarks, patents, copyright and intellectual property.

These Terms allow you to use the Services for personal, non-commercial use only. You must not reproduce, distribute, modify, create copies of, publicly display and perform, republish, download, store or transmit material relating to the Services without our written consent. Except as expressly stated, nothing in these Terms grants or may be construed as granting you a licence or other rights in relation to patents, trademarks, copyright or other intellectual property of SANGIORGIO srl or of third parties. Unauthorised use of the Services may result in a breach of intellectual property laws. All rights not expressly granted in this document are reserved to SANGIORGIO srl.

The names, logos, product and service names, designs and slogans of SANGIORGIO srl are trademarks of SANGIORGIO srl or of its affiliates or licensors. You must not use those trademarks without the written authorisation of SANGIORGIO srl. All other names, logos, product and service names, designs and slogans appearing in the Services are trademarks of their respective owners.

You may have access to customer tools offered by third parties as part of the Services, which we do not check, control or supply.

You understand and agree that we provide access to such tools "as is" and "as available" without any kind of warranty, representation or condition and without any support. We have no liability arising from or relating to your use of optional third-party tools.

Your use of the optional tools offered through the site is at your own risk and discretion and, furthermore, you must be aware of and accept the terms on which those tools are provided by the relevant third-party suppliers.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Our online store is built on the Shopify platform, which enables us to provide you with the Services. However, the sales and purchases you make in our store take place directly with SANGIORGIO srl. By using the Services you understand and agree that Shopify is not responsible for any aspect of the sales between you and SANGIORGIO srl, including any injury, damage or loss arising from the purchase of products and services. You expressly release Shopify and its affiliates from all claims, damages and liabilities arising from or relating to the purchases and transactions you make with SANGIORGIO srl.

All personal data we collect through the Services is subject to our Privacy Policy. By using the Services you confirm that you have read that policy.

SANGIORGIO srl collects and processes personal data relating to your access to and use of the Services in order to provide and improve the Services. You confirm that your Feedback will not infringe any right of any third party, including rights of copyright, trademark, privacy, personality and any other personal or proprietary right. You further confirm that your Feedback will not include defamatory or otherwise unlawful, offensive or obscene content, nor will it contain viruses or other computer malware that could affect the operation of the Services or of any linked website. You must not use a false email address, pretend to be someone else, or mislead us or third parties as to the origin of your Feedback. Your Feedback and its accuracy are your sole responsibility. We assume no responsibility for Feedback published by you or by third parties.

In addition, you agree not to: (a) upload or transmit viruses or other types of malicious code that could be used to affect the functioning or operation of the Services; (b) reproduce, duplicate, copy, sell, resell or exploit any part of the Services; (c) collect or track other people's personal data; (d) engage in spamming, phishing, pharming, pretexting, spidering, crawling or scraping; (e) interfere with or circumvent the security features of the Services or of the related websites, of other websites or of the internet. We reserve the right to suspend, disable or close your account at any time, without notice, if we believe that you have breached any part of these Terms.

We may terminate this agreement or discontinue your access to the Services (or to any part of them) at any time, at our discretion and without notice; you will remain responsible for all amounts due up to the date of termination.

The following sections will continue to apply after termination: Intellectual property, Feedback, Termination, Warranty limitation, Limitation of liability, Indemnity, Severability, Governing law and place of jurisdiction, Privacy Policy and any other clause that by its nature survives termination.

SECTION 15 - WARRANTY LIMITATION

The information presented in or through the Services is made available for general information purposes only. We do not warrant the accuracy, completeness or usefulness of that information. You rely on that information entirely at your own risk. The legal guarantee of conformity provided for by European law on the products purchased remains unaffected.

To the extent permitted by law, SANGIORGIO srl is not liable to users for any damage or loss arising from the use of the site, of the services offered or of the products purchased online.

In particular, SANGIORGIO srl may not be held liable for economic losses (such as lost profits or revenue), loss of data or other indirect or consequential damages, even if foreseeable.

Furthermore, SANGIORGIO srl does not warrant that the content of the site is always free of errors or omissions and is not liable for any damage arising from the use of the information, products or services available on the site, even where it has been informed of the possibility of such damage.

No clause of these Terms limits or excludes the liability of SANGIORGIO srl in cases where this is not permitted by law, nor the rights that the law grants to consumers.

SECTION 17 - INDEMNITY

You agree to indemnify and hold harmless SANGIORGIO srl, as well as its partners, affiliates, service providers (including the Shopify platform), directors, employees and collaborators, from any loss, damage, liability or claim brought by third parties, including reasonable legal costs, arising from: (1) a breach by you of these Terms and conditions or of the documents referred to in them; (2) a breach of applicable laws or of the rights of third parties; (3) an improper use of the site, of the services or of the products purchased through it.

We will promptly inform you of any claims for which you may be required to respond, it being understood that any delay in such communication does not release you from your obligations, unless it causes you actual prejudice.

SANGIORGIO srl reserves the right to handle the defence and the settlement of the claim, including through its own trusted lawyers, at your expense. In any case, no settlement involving non-monetary obligations on your part will be accepted without your prior consent, which may not be withheld without good reason.

You further undertake to cooperate, on request, in the conduct of the defence by providing all useful information and documents.

SECTION 18 - SEVERABILITY

In the event that any clause of these Terms of Service is held to be unlawful, void or unenforceable, that clause will nonetheless be enforceable to the fullest extent permitted by applicable law and the unenforceable part will be deemed severed from these Terms of Service. Such severance will not affect the validity and enforceability of the remaining clauses.

SECTION 19 - GOVERNING LAW AND PLACE OF JURISDICTION

These Terms of Service and any separate agreement under which we provide you with the Services are governed by Italian law, in particular by Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 on electronic commerce, to the exclusion of the conflict-of-laws rules of private international law. The mandatory consumer protection provisions of the law of your country of habitual residence remain unaffected where they are more favourable.

If you are a consumer resident or domiciled in Italy, pursuant to art. 66-bis of the Consumer Code the mandatory territorial jurisdiction lies with the court of the place of your residence or domicile.

If you are a consumer resident or domiciled in another country, you may bring proceedings, at your own option, before the court of your own place of residence or domicile or before the Court of Lecco, where SANGIORGIO srl has its registered office.

If you are not acting as a consumer, the Court of Lecco shall have exclusive jurisdiction over any dispute.

Before bringing proceedings before a court, we invite you to report the problem to us by writing to info@sangiorgiomerate.it: most complaints are resolved at this stage.

The headings used in this agreement are included for convenience only and do not limit or affect these Terms.

SECTION 21 - CHANGES TO THE TERMS OF SERVICE

You may consult the current version of the Terms of Service at any time on this page.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by publishing the updates and changes on our website. It is your responsibility to check our website periodically for changes. We will notify you of changes to any material part of these Terms in accordance with applicable laws, and such changes will be effective from the date indicated in the notice. Your continued use of or access to the Services following changes to the Terms of Service constitutes your acceptance of those changes.
